TERMS & CONDITIONS

Welcome to ArteVue, an online art gallery offering original artwork, limited-edition and open-edition prints, reproductions, and other art-related products and services.
These Terms & Conditions (“Terms”) govern your access to and use of the ArteVue website, including purchases made through the website.
By accessing or using the ArteVue website, or by purchasing any artwork or product through the website, you acknowledge that you have read, understood, and agreed to these Terms.
1. ABOUT ARTEVUE
ArteVue is an online art gallery located in Orlando, Florida, USA.
For purposes of these Terms, “ArteVue,” “we,” “us,” and “our” refer to ArteVue and its applicable owners, operators, affiliates, representatives, and service providers.
“Customer,” “you,” and “your” refer to any person accessing the website or purchasing products from ArteVue.
2. ARTWORK AND PRODUCT INFORMATION
ArteVue makes every reasonable effort to provide accurate descriptions, dimensions, photographs, colors, materials, availability, and other information relating to artwork displayed on the website.
However:

Original artwork is handmade and may contain natural variations in texture, brushwork, color, finish, and surface characteristics.

Colors displayed on computer monitors, tablets, and mobile devices may differ from the actual artwork.

Dimensions are provided as accurately as reasonably possible.

Minor variations between website images and the physical artwork do not necessarily constitute defects.

Artwork descriptions may include artistic, historical, emotional, or interpretive statements that represent the artist's or gallery's description of the work.
Unless expressly stated otherwise, photographs and digital images displayed on the website are intended to represent the artwork as accurately as reasonably possible.
3. ORIGINAL ARTWORK
When a listing identifies a work as an “Original,” the purchaser is purchasing the physical original artwork described in that listing.
Unless expressly stated otherwise, the purchase of an original artwork does not transfer copyright, trademark rights, reproduction rights, publishing rights, licensing rights, or other intellectual-property rights in the artwork.
Copyright and all reproduction rights remain with the artist or applicable rights holder unless a separate written agreement expressly provides otherwise.
The purchaser may display the physical artwork for personal or commercial interior-decoration purposes, subject to applicable law, but may not reproduce, scan, photograph for commercial reproduction, manufacture merchandise from, license, or otherwise commercially exploit the artwork without written permission from the copyright owner.
4. PRINTS AND REPRODUCTIONS
Prints and reproductions are sold according to the specifications provided on the applicable product page.
Where applicable, listings will identify:

Print size;
-
Paper or other printing material;
-
Edition information;
-
Whether the item is signed;
-
Whether the item is numbered;
-
Framing information;
-
Shipping information; and
-
Any other material characteristics.
Unless expressly stated, purchasing a print does not grant the purchaser copyright or reproduction rights to the underlying artwork.
5. DIGITAL ARTWORK AND DIGITAL DOWNLOADS
If ArteVue offers artwork or other products in digital-download form, the customer receives a limited, non-exclusive, non-transferable license to use the purchased digital file for the purposes expressly stated on the applicable product page.
Unless expressly authorized in writing, digital files may not be:

Resold;
-
Redistributed;
-
Uploaded to commercial marketplaces;
-
Used to create merchandise for sale;
-
Used in commercial advertising;
-
Licensed to third parties;
-
Shared publicly for downloading;
-
Altered and resold; or
-
Used to create derivative commercial products.
Because digital products may be delivered immediately after purchase, digital-download purchases may be non-refundable once the file has been accessed or downloaded, except where otherwise required by applicable law or where ArteVue determines that a refund is appropriate.
6. PRICES
All prices displayed on ArteVue are subject to change without notice.
The price charged for an order will generally be the price displayed at the time the customer completes the purchase, subject to correction of obvious pricing or listing errors.
ArteVue reserves the right to correct typographical, pricing, product-description, or other errors and, where legally permitted, to cancel an order affected by such an error.
If an order is canceled because of a pricing or listing error, any amount actually charged to the customer for that order will be refunded.
7. SALES TAX
Applicable sales taxes will be calculated and displayed during checkout where required.
Florida imposes sales tax on taxable tangible personal property delivered to customers in Florida, and applicable county discretionary sales surtax may also apply.
Tax treatment may vary depending on the customer's location, the nature of the product, and applicable law.
Customers are responsible for any taxes, duties, customs charges, or other governmental charges that may apply to purchases shipped outside the United States.
8. PAYMENT
ArteVue accepts the payment methods displayed during checkout.
By submitting payment information, you represent that:

You are authorized to use the payment method;

The information provided is accurate and complete; and

You authorize ArteVue or its authorized payment processor to charge the amount associated with your purchase.
ArteVue does not intentionally retain complete payment-card information when such information is processed through third-party payment processors.
Payment processing may be subject to the terms and privacy policies of the applicable payment provider.
9. ORDER ACCEPTANCE
Submitting an order constitutes an offer to purchase.
An automated order confirmation acknowledges receipt of the order but does not necessarily constitute final acceptance of the order.
ArteVue reserves the right to refuse, cancel, or limit an order for legitimate reasons, including:

Artwork availability;

Pricing or listing errors;
-
Suspected fraudulent activity;
-
Payment problems;
-
Shipping restrictions;
-
Duplicate orders; or
-
Other circumstances affecting the ability to fulfill the order.
If ArteVue cancels an order after payment has been received, ArteVue will issue an appropriate refund.
10. AVAILABILITY OF ORIGINAL ARTWORK
Original artwork is generally unique and may be available for purchase only once.
If an original artwork is sold to another customer before an order is successfully completed, ArteVue may cancel the order and refund the customer.
Artwork displayed on the website may also be subject to temporary unavailability, exhibition commitments, or other circumstances affecting fulfillment.
11. SHIPPING AND DELIVERY
ArteVue will make reasonable efforts to ship purchases within the timeframe stated on the applicable product page or order confirmation.
Shipping dates are estimates unless a specific guaranteed delivery date is expressly provided.
For online merchandise orders, federal law generally requires sellers to ship within the time stated in their advertising or, if no shipping time is stated, within 30 days, subject to applicable exceptions. If a seller cannot meet its shipping commitment, applicable rules may require notification and an opportunity for cancellation and refund.
Shipping charges will be displayed during checkout whenever reasonably practicable.
Customers are responsible for providing an accurate shipping address.
ArteVue is not responsible for delays caused by circumstances beyond its reasonable control, including carrier delays, severe weather, natural disasters, governmental actions, transportation disruptions, or other force-majeure events.
12. INTERNATIONAL SHIPPING
International orders may be subject to customs duties, import taxes, brokerage fees, tariffs, or other charges imposed by the destination country.
Unless expressly stated otherwise, such charges are the responsibility of the purchaser.
ArteVue cannot guarantee that every artwork or product may legally be imported into every country.
Customers are responsible for complying with applicable laws governing the importation of purchased artwork.
13. ARTWORK INSPECTION UPON DELIVERY
Customers should inspect artwork promptly after delivery.
If artwork arrives visibly damaged, the customer should:

Photograph the shipping box before opening it;
-
Photograph the packaging materials;
-
Photograph the artwork and any visible damage;
-
Retain all packaging materials; and
-
Contact ArteVue as soon as reasonably possible.
Damage claims may require photographs and documentation so that ArteVue and/or the shipping carrier can investigate the claim.
14. RETURNS AND REFUNDS
ArteVue's return policy will be stated on the applicable product page or in the applicable order documentation.
Unless otherwise expressly stated:
Original artwork: Because original artwork is unique and often individually prepared, sales of original artwork may be final except where the artwork arrives damaged, is materially different from the description, or a return is otherwise required by applicable law.
Prints and physical reproductions: Eligible returns must be requested within the period stated in the applicable return policy and must generally be returned in original, undamaged condition.
Custom or personalized artwork: Custom-made or personalized artwork may be non-returnable unless defective, damaged, materially different from the agreed specifications, or otherwise required by applicable law.
Digital downloads: Digital products that have been accessed or downloaded may be non-refundable except where required by law or otherwise stated by ArteVue.
Nothing in these Terms is intended to eliminate any consumer rights that cannot legally be waived.
Customers should review the specific return policy associated with their purchase before completing the transaction. Clear disclosure of refund and return conditions is important for online sales.
15. CANCELLATIONS
A customer may request cancellation of an order by contacting ArteVue as soon as possible after placing the order.
Cancellation requests are not guaranteed once an order has been processed, shipped, customized, or otherwise committed for fulfillment.
Custom artwork, commissioned pieces, and personalized products may be subject to special cancellation terms disclosed before purchase.
16. ARTIST RIGHTS AND COPYRIGHT
All artwork displayed on ArteVue, including paintings, drawings, photographs, illustrations, graphics, videos, written descriptions, logos, website designs, and other content, may be protected by copyright, trademark, and other intellectual-property laws.
Unless expressly stated otherwise, all such rights remain with ArteVue, the artist, or the applicable rights holder.
No content on the website may be copied, reproduced, republished, distributed, modified, transmitted, sold, licensed, or commercially exploited without prior written authorization.
Purchasing an artwork does not transfer intellectual-property rights in the artwork.
17. WEBSITE CONTENT
ArteVue reserves the right to modify, remove, update, or discontinue website content, products, artwork listings, pricing, promotions, or services at any time.
We attempt to maintain accurate information but do not guarantee that every piece of website content will always be complete, current, or error-free.
18. USER SUBMISSIONS
If you submit reviews, comments, testimonials, photographs, messages, or other content to ArteVue, you represent that you have the right to submit such content.
By submitting content, you grant ArteVue a non-exclusive, worldwide, royalty-free license to reproduce, display, publish, distribute, and use the submission for legitimate business, promotional, marketing, website, social-media, and advertising purposes, subject to applicable law.
ArteVue reserves the right to remove submissions that are unlawful, defamatory, abusive, misleading, offensive, or otherwise inappropriate.
19. PROHIBITED USE
You agree not to use the ArteVue website to:

Violate applicable law;

Commit fraud;

Misrepresent your identity;

Interfere with website operations;
-
Attempt unauthorized access to systems;

Copy website content for unauthorized commercial purposes;

Upload malicious software;
-
Scrape or systematically reproduce website content without authorization;

Infringe intellectual-property rights; or
-
Engage in any activity that could damage ArteVue, its artists, customers, or service providers.
20. THIRD-PARTY SERVICES AND LINKS
ArteVue may use third-party providers for payment processing, shipping, website hosting, analytics, advertising, social-media integration, email communications, and other services.
ArteVue may also provide links to third-party websites.
ArteVue is not responsible for the content, policies, security, availability, or practices of third-party websites or services.
Your use of third-party services may be subject to their own terms and privacy policies.
21. PRIVACY
ArteVue may collect information necessary to process orders, communicate with customers, provide services, maintain the website, prevent fraud, and conduct legitimate business activities.
Personal information will be handled in accordance with ArteVue's Privacy Policy.
Customers should review the Privacy Policy before using the website or submitting personal information.
22. DISCLAIMER
To the maximum extent permitted by applicable law, the ArteVue website and its content are provided on an “as available” basis.
ArteVue does not guarantee that:

The website will always operate without interruption;

The website will always be free of errors;

Website content will always be completely accurate;
-
The website will be free from viruses or other harmful components; or
-
Every product will remain continuously available.
Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.
23. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, ArteVue and its owners, officers, employees, contractors, affiliates, artists, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of the website or purchase of artwork, except to the extent such limitation is prohibited by law.
Where legally permitted, ArteVue's aggregate liability relating to a particular purchase will not exceed the amount actually paid by the customer for the specific product giving rise to the claim.
This limitation does not apply to liability that cannot legally be limited or excluded.
24. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless ArteVue and its owners, officers, employees, contractors, affiliates, and service providers from claims, damages, liabilities, costs, and expenses arising from:

Your violation of these Terms;

Your unlawful use of the website;
-
Your infringement of another person's rights; or
-
Your misuse of purchased artwork or digital content.
25. GOVERNING LAW
These Terms shall be governed by and interpreted in accordance with the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable federal law or mandatory consumer-protection laws provide otherwise.
26. DISPUTE RESOLUTION
ArteVue encourages customers to contact us first to attempt to resolve any dispute informally.
If a dispute cannot be resolved informally, the parties may pursue remedies available under applicable Florida and federal law.
Any contractual requirement for arbitration, mediation, venue, or waiver of jury trial should be added only after review by qualified Florida legal counsel.
27. FORCE MAJEURE
ArteVue shall not be responsible for failure or delay in performing its obligations when such failure or delay results from circumstances beyond its reasonable control, including natural disasters, severe weather, fire, flood, war, terrorism, governmental actions, labor disruptions, transportation interruptions, internet outages, supply-chain disruptions, or failures of third-party service providers.
28. CHANGES TO THESE TERMS
ArteVue may update these Terms from time to time.
Updated Terms will become effective when posted on the website unless otherwise stated.
Your continued use of the website after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
29. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.
30. ENTIRE AGREEMENT
These Terms, together with the applicable Privacy Policy, Return/Refund Policy, Shipping Policy, and any other policies expressly incorporated into these Terms, constitute the agreement between you and ArteVue concerning your use of the website and purchases made through it.
Specific written agreements concerning commissioned artwork, licensing, exhibitions, artwork leasing, or other special transactions may supersede these Terms with respect to that transaction.

All artwork, images, photographs, text, logos, graphics, and other content displayed on ArteVue are protected by copyright and other intellectual-property laws.
Unless expressly stated otherwise, all copyrights and reproduction rights remain with ArteVue, the artist, or the applicable rights holder.
Purchasing an original artwork or print does not transfer copyright or reproduction rights to the purchaser.
